Introduction

This policy describes our data and privacy practices for the information Warehouse Cinemas, LLC, its subsidiaries, licensees, and affiliated companies (collectively, "Company", " we", “our”, or “us” ), may collect from you or that you may provide through our website, www.warehousecinemas.com, or any other website, mobile application, product, feature, social media site, or service operated by the Company that posts or provides this policy, participation in the Warehouse Cinemas rewards program, or any sweepstakes, promotion, or survey offered by us, disclosure of personal information to us through any other means including written or electronic communication (collectively, " Website "), and by Warehouse Cinemas offline, which we may combine with online data.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree to the terms and conditions of this privacy policy, do not use our website . By accessing, using, submitting data to, or otherwise interacting with this Website or providing information to us, you agree to the practices described in this Privacy Policy. INDIVIDUALS UNDER THE AGE OF 18

Our Website is not intended for individuals under 18 years of age and we do not collect personal information from minors younger than 18. No one under age 18 may provide any information, personal or otherwise, to or on the Website. We do not knowingly collect personal information from children under 18. If you are under 18, do not use or provide any information on this Website or on or through any of its features/register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn that we have collected or received personal information from an individual under 18 years of age without verification of parental consent, we will delete that information. PERSONAL, SENSITIVE, AND NON-PERSONAL INFORMATION WE COLLECT 

We may collect several types of information from and about users of our Website directly, automatically when you visit the Website, and sometimes from third parties. Some of this data may be considered

“personal information” or “personal data,” and some of which may be considered “sensitive” under various applicable laws. We will also treat other information, including IP addresses and cookie identifiers as “personal data” where required by applicable law and we will treat certain personal data as “sensitive data” where required by applicable law.

Note that we may de-identify or pseudonymize personal data so that it is non-personal, such as aggregating (such as combining it with data about other individuals) and/or or converting it to a code, sometimes using a function commonly known as “hash”, or otherwise removing characteristics that make the data personally identifiable to you. We maintain and use de-identified data without attempting to re-identify it, except where permitted by applicable law, such as to determine whether our de-identification processes satisfy legal requirements. We will treat de-identified or pseudonymized data as non-personal to the fullest extent allowed by applicable law. If we combine non-personal data with personal data, then we will treat the combined information as personal data under this Privacy Policy.

DATA YOU PROVIDE DIRECTLY

We may ask you to provide data directly, such as contact data (name, postal address, e-mail address, telephone number, and any other data about you (for example, your birthday, account information, preferences and interests).

Payment Information . When you make a purchase, we collect payment data, such as credit card, billing, and other financial information, and information about your transaction history. You also have the option to store payment information for future purchases. We may use third party payment processors.

One of the companies we use to handle payments is Stripe, Inc. We use Stripe for payment, analytics, and other business services. Stripe collects and processes personal data, including identifying information about the devices that connect to its services. Stripe uses this information to operate and improve the services it provides to us, including for fraud detection and prevention. User Content and Submission Features . The Website may permit you to submit or post photos, audio, video, text, files, social media posts, or other content (“User Content”) through interactive or other features, such as reviews, ratings, or promotional activities (“Submission Features”). Your submission of User Content is subject to the Terms of Service for the Website which give us the right to use your User Content, online or offline, in connection with our promotional activities. Personal information, such as your name, user name (from the Website or your social media account), or where you reside, may be publicly displayed with your User Content. Others may access it, use it, and share it. We are not responsible for how others use User Content you submit or post. In addition, In connection with certain activities, your personal information may be disclosed publicly, for example, being identified as a winner of a sweepstakes or being awarded a prize.

Customer Support . When you participate in a customer service or similar chat feature with us, Warehouse Cinemas may record, use, and retain your communications and the data you provide in order to provide customer support, for quality assurance, and to improve our products and services. If you do not consent, please do not continue with customer assistance.

You acknowledge that if you choose to post any information about your viewing history on a third-party platform, or by liking or sharing any content, the Video Privacy Protection Act of 1998 (18 U.S.C. § 2710) (or any similar state law) does not apply. However, to the extent it does apply in any manner, you are providing your informed, written consent to the disclosure of that information pursuant to the Video Privacy Protection Act.

INFORMATION WE COLLECT AUTOMATICALLY WHEN YOU USE OR ACCESS THE WEBSITE

As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain information, including:

Cookies, Pixels, Tags, and Other Technologies . Warehouse Cinemas and our third-party business partners (including any third-party service providers or third-party content, advertising, and analytics providers) may use a variety of technologies, including cookies, pixel tags, and web beacons, that automatically or passively collect information on your access, usage, and other interactions with the Website (“ Device ID/Interaction Information ”).

Device ID/Interaction Information may include, but is not limited to:

How you use and interact with our Website, including, the pages you visit, the amount of time that you are on the site, tickets you view and add to your cart, and other related analytics.

Cookies (or browser cookies) and Local Storage . A cookie is a small file placed within a browser on a device when it is used to visit the Website. Certain web browsers and browser add-ons may provide additional local data storage mechanisms. We may use cookies and similar technologies to help keep your use of the Website more secure, to send email reminders based on your activity on our Website, including browse/cart abandonment (e.g., information and alerts based on the listings you viewed on our website), to study traffic patterns on the Website, to study the effectiveness of our customer communications, to maintain the integrity of the Website, to measure crash analytics and other maintenance related data, to manage and measure the performance of advertisements displayed on or delivered by or through the Website, and to personalize your experience through the Website, such as to recognize you when you return to the Website. Pixels. Pages of our Website and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs). These and other similar technologies may be used for a number of purposes by us and our third-party providers, including to permit the Company to count users who have visited those pages or opened an email, to monitor how users navigate the Website, toto count how many particular products were viewed, for marketing and targeted advertising purposes, and for other website statistics (for example, measuring the popularity of certain website content and verifying system and server integrity). The data we collect through this technology may include the first date and time you open our email, and whether you click any links included in our email.

Embedded Scripts . An embedded script is programming code that is designed to collect data about your interactions with the Website, such as the links you click on. The code is temporarily used by our server or a third-party service provider or business partner while you browse or interact with the Website and is deactivated or deleted when you disconnect from the Website.

Data Collected Through Mobile Devices and SDKs . We use embedded scripts and the tools provided in Software Development Kits (“SDKs”) to collect data through mobile devices such as the hardware model, operating system and version, identification numbers assigned to your mobile device, such as the ID for Advertising (IDFA) on Apple devices, and the Advertising ID on Android devices, mobile network data, and website usage behavior. SDKs are software packages that contain a set of tools that can be used to help build applications and implement new features in existing apps including those that collect data from your device.

Precise and Approximate Location Data . In some cases, we may directly collect precise location data through your device solely to help you find the closest theater and showtime selections, if you have opted in to the collection of that data. You may be able to turn off the collection of location data through the settings on your device. However, please note that we may still be able to collect or infer your approximate location through other data we collect, such as IP address. In addition, some mobile service providers may also provide us or our third-party providers with data regarding the physical location of the device used to access the Website.

DATA WE COLLECT FROM THIRD PARTIES

Enhancement Data . We may receive data about you from other third parties, such as data aggregators, joint marketing partners, third party websites, service providers and other business partners. We may also supplement the data we collect with outside records from third parties, such as public databases, publicly available social media pages, and third parties who enhance the data we have about you, in order to provide you with information or services you have requested, to tailor content, to offer you opportunities to purchase products or services that we believe may be of interest to you, and for other purposes. The data collected and stored by third parties is subject solely to the third party’s privacy practices.

How We Use Your Information

We may use information that we collect about you or that you provide to us, including any personal information and Device ID/Interaction Information as follows:

  • To Provide the Website and its Contents to You , such as to enable you to use the Website; create and manage your account information; process your purchases; send order and account-related communications, such as receipts and confirmations; provide you with information, products, or services that you request from us; respond to your questions, complaints or comments and ask for your feedback; process information you provide to us; provide customer service and support; provide you with notices about your account, including expiration and renewal notices (as applicable); allow you to participate in interactive features on our Website, as they are developed; and facilitate your participation in rewards or loyalty programs and in sweepstakes, contests, and other promotions.
  • To Personalize Your Experience , such as to store your theater location preference, identify your interests and preferences and tailor the content, recommendations, and advertising we display to you and others, on the Website and elsewhere, including as described in the section titled “Third Party Advertising and Analytics Third Parties and Similar Third Parties.” 
  • To Send Marketing Messages , such as to send you information about Warehouse Cinemas and third parties by email, mail, text message, push notification, or other means, including to send you information about films, events, and offers, or information about tickets or merchandise you have shown interest in.
  • For Legal Purposes , such as to resolve legal disputes; carry out our contractual obligations; enforce our rights arising from any contracts entered into between you and us, including for billing and collection; enforce our policies; cooperate with government or other legal inquiries; fulfill regulatory reporting obligations; protect ours or others’ rights or interests, which may include sharing data with other companies, lawyers, courts, or other government entities.
  • For Administrative Purposes , such as to verify your identity, including that your email address is active and valid; contact you regarding your use of the Website, content, features, or products or other administrative matters, such as changes to our Website or any products or services we offer or provide though it, or changes to our Privacy Policy, Terms of Service, or other policies.
  • For Internal Business Purposes , such as to improve the overall content and experience of our Website; facilitate your job application; detect and troubleshoot problems; analyze the effectiveness of our marketing efforts; analyze trends, statistics, and usage patterns; market research; conduct sales auditing; comply with legal requirements and our business policies and practices, such as our recordkeeping, backup, and document retention policies.
  • For Security, such as to investigate, detect, prevent, and protect against misuse of our systems, fraud, crime, or other illegal activities or activities that violate our policies or the law.
  • In Connection with Business Transitions , such as when evaluating or engaging in a merger, acquisition, consolidation, bankruptcy, or other corporate transition affecting all or part of our assets, including during the course of due diligence.

Disclosure of information to third parties

We may otherwise share the information that we have collected about you (including personal information in the circumstances described below or elsewhere in this Privacy Policy, as disclosed at the time you provide the data, or otherwise with your consent:

  • Third parties providing services on our behalf. We may share personal information about you with vendors who provide services on our behalf, such as fulfilling orders, providing processing or other information technology services, marketing our services to you on our behalf, carrying out research and analysis, and personalizing your guest experience, site and app development, website hosting, data analytics, product shipping, sending email or other communications, security and fraud prevention vendors, and similar entities. We do not allow these third parties to use or share this information for any purpose other than to provide services on our behalf.

  • Third party advertising and analytics partners. TAs fully described in the section below titled “Third Party Advertising and Analytics Third Parties and Similar Third Parties”, we share (or allow third parties to collect) certain data, including about how you use the Website, to target advertising to you and others and assess the effectiveness of our advertising, and for similar purposes. We do not share your personal data with third parties for those third parties’ direct marketing purposes without providing you the ability to consent (opt-in or opt-out). We may share information when you direct us to do so, including when you log in through a third-party application or feature through which information is shared, or if we present you with an opportunity to receive marketing offers from a third party. Please note that we are not responsible for the privacy practices of any third party. If you decide that you do not want to receive communications from a third party, or have questions about their privacy practices, you will need to contact that third party directly. If you choose to post information to a third-party platform, that information may be public.

  • Third party integrations/other third parties to whom you agree or direct us to share data. TWe may share certain data when you interact with a third party that is integrated in our Website. We may also include content on the Website provided by third-party form and product registration vendors, third-party partners like retailers and other organizations, and other third-party websites.

    We may otherwise share your personal information when you consent or otherwise direct us to do so. For example, if you engage with third party payment options or with another third-party social media application or other feature through which data is shared, or if we present you with an opportunity to receive marketing offers from a third party. Please note that we are not responsible for the privacy practices of any third party. If you decide that you do not want to receive communications from a third party, or have questions about their privacy practices, you will need to contact that third party directly.

    If you choose to post information to a third-party platform, that information may be public.

  • Sweepstakes, contests, promotions. We may offer sweepstakes, contests, or other promotions (any, a "Promotion"), that may require registration. By participating in a Promotion, you are agreeing to the provisions, conditions, or official rules that govern the Promotion, which may require specific requirements of you (including, without limitation, and except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness, or other indicia of persona in advertising or marketing materials). If you choose to enter a Promotion, personal data may be disclosed to third parties or the public in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, as required by law or permitted by the Promotion’s terms or official rules (such as on a winners list).

  • Administrative and legal purposes.Warehouse Cinemas reserves the right to use or disclose any data as needed to satisfy any law, regulation or legal request; to protect the integrity of the Website; to fulfill your requests; to cooperate in any law enforcement investigation, an investigation on a public safety matter, or an investigation into claims of intellectual-property infringement; to protect and defend the legal rights or property of Warehouse Cinemas, our affiliates and shareholders, any Website or its users, or any other party; or, in an emergency, to protect the health and safety of our users or the general public. We may also use Device Identifiers to identify users, and may do so in cooperation with copyright owners, Internet service providers, wireless service providers, or law enforcement agencies, in our discretion.

  • Business transitions. In the event Warehouse Cinemas goes through a business transition, Warehouse Cinemas reserves the right to disclose and transfer all personal data related to the Website (including, without limitation, during the course of any due diligence process): (i) to a subsequent owner, co-owner or operator of the Website; or (ii) in connection with a corporate merger, consolidation, restructuring, bankruptcy, the sale of certain of Website Cinemas’ ownership interests, assets, or both, or other company change. By providing your data, you understand and agree that we may transfer such data to the acquiring entity without your further consent, except where required by law.

  • Employment applications. If you apply for a job with us, we or our service provider(s) may ask you to provide self-identifying information (such as veteran status, gender, and ethnicity) in conjunction with laws and regulations enforced by the Equal Employment Opportunity Commission and other federal, state, and local regulatory agencies. Providing such self-identifying information is voluntary, but if you do provide such information, we and/or our service providers may submit that information to the appropriate government or regulatory agencies to fulfill reporting requirements and use that information to defend against employment-related complaints. Please note that we may utilize a careers portal that is operated by a third party, in which case, your registration and use of the careers portal will be subject to the third party’s privacy practices as disclosed on the portal.   • Non-personal data. Except as expressly prohibited by law, we may share non-personal data that we collect, such as certain Device ID/Interaction Information, aggregate user statistics, and hashed or otherwise de-identified or pseudonymized data (including email addresses), and/or our analyses derived from such data, with third parties in our discretion, including for targeted advertising purposes.
  • THIRD PARTY ADVERTISING AND ANALYTICS THIRD PARTIES AND SIMILAR THIRD PARTIES

    We may use third party business partners, such as analytics companies, ad agencies, network advertisers, and others who provide us with data about the Website, users, and our advertisements, and who deliver ads to you on our behalf on the Website and elsewhere online. We and our third-party business partners collect certain data about your visits to and activity on the Website and other websites and services, including as described in “Social Media and Other Third Party Platforms” [Link], and may use this data to target advertising to you and others and to assess the effectiveness of our advertising. We may also share (or permit third parties to collect) certain data, such as Device ID/Interaction Information, aggregated or de-identified, pseudonymized or hashed data (including email addresses), with these third parties for similar purposes.

    These third parties may set and access their own tracking technologies on your device (including cookies, web beacons or other technology) and may otherwise collect or have access to your personal data over time, including about your visits to the Website as well as other websites and online services, some of which may be personal information or personal data under various state laws. Companies that we share data with, including ad agencies and networks, may use the data, often in combination with their existing data, in order to present more relevant advertisements that may be of interest to you, and to help us and third parties to do the same.

    • NAI/DAA Opt Out . Some of the companies we use may be members of the Network Advertising Initiative (“NAI”) or Digital Advertising Alliance (“DAA”). The NAI provides information regarding targeted advertising and the opt-out procedures of NAI members, including opt-out mechanisms for web browsers, mobile and other connected devices, and a tool to opt out from participating NAI members using your hashed email address for interest-based advertising.     • Google Analytics . We use Google Analytics, which uses cookies and similar technologies to collect and analyze data about the use of the Website and report on activities and trends. This service may also collect data about the use of other websites, apps, and online services.     Please note that opting out through these mechanisms does not opt you out of being served advertising, and that you will continue to receive generic ads while online.     SOCIAL MEDIA & OTHER THIRD PARTY PLATFORMS 

    The Website may permit or facilitate interactions with an interactive third-party website or service ("Social Media"), such as enabling you to "like" or "share" content. If you choose to share content or otherwise post information from or via the Website to Social Media, that data may be public, and the third party may have access to data about you and your use of the Website. You may also choose to participate on Social Media in a way that connects that third-party service with the Website (such as posting to one of our pages on a Social Media site). Doing so may allow us to collect (or the third party to share) data about you. These third-party Social Media platforms may be able to collect certain data about your visits to the Website regardless of whether or not you affirmatively interact with the feature and whether or not you are logged into (or have) an account with the third-party platform.

    We may also receive data about you if other users of Social Media give us access to their profiles and you are one of their connections or "friends". The data we collect is subject to this Privacy Policy. The data collected and stored by the third party remains subject to the third party’s privacy practices, including,

    without limitation, whether the third party continues to share data with us, the types of data shared, and your choices with regard to what is visible to others on that third-party website or service. The third party may allow you to remove the application or feature, in which case we will no longer collect data about you through the application or feature, but may retain the data previously collected.

    THIRD PARTY LINKS AND CONTENT 

    Warehouse Cinemas is not responsible for the privacy policies of third parties or other sites, even if they are linked to our Website. Warehouse Cinemas includes these links solely as a convenience to you, and the presence of such a link does not imply a responsibility for the linked site or an endorsement of the linked site, its operator, or its contents. Please make sure you read their privacy policy before using those sites when you leave our Website.

    YOUR CHOICES 

    We strive to provide you with choices regarding the personal information you provide to us.

    Communication from us 

    We have created mechanisms to provide you with the following control over your information:

    Promotional Offers from the Company . You may unsubscribe from marketing emails we send you through the opt-out mechanism included in each such email. You can also opt-out by sending us an email stating your request to privacy@warehousecinemas.com. Or if we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. Note, however, that we reserve the right to send you certain communications relating to your use of the Website, notices of changes to this Privacy Policy or other terms, or similar administrative and transactional messages.

    Push Notifications . We may send promotional and non-promotional push notifications or alerts to your mobile device, and may in some cases do so based on your device’s location or physical proximity to a beacon. You can elect to stop receiving those messages at any time by changing the notification settings on your mobile device.

    ACCESSING AND CORRECTING YOUR INFORMATION

    You are responsible for maintaining the accuracy of the data you submit to us, such as your contact data. You may update the data you have provided to us by logging into your account, selecting “Account” from the drop down menu, and either navigating to the “Account Overview” tab, and selecting “Edit” on the Personal Details box or by navigating to the “Account Information” tab. You may delete your account by selecting the “Delete Account” button in the “Account Overview” tab. Warehouse Cinemas will make good faith efforts to make requested changes in our then active databases as soon as reasonably practicable. Note, however, that data may persist internally for administrative purposes and that residual data may remain on backup media or for other reasons. You may also send us an email at privacy@warehousecinemas.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.     If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other Website users.     DATA SECURITY 

    We use commercially reasonable measures designed to protect your personal information. However, the transmission of information via the Internet, wireless transmission, and electronic storage is not guaranteed as completely secure. Warehouse Cinemas cannot ensure or warrant the security any information we collect. You use the Website and provide us your information at your own risk.

    CHANGES TO OUR PRIVACY POLICY

    To the extent permitted by applicable law, we reserve the right to change or modify this Privacy Policy at our discretion at any time. We will notify you of material changes by posting the changed or modified Privacy Policy on our Website. Any changes will be effective immediately upon the posting of the revised Privacy Policy unless otherwise specified. Your continued use of the Website after the effective date of the revised Privacy Policy (or such other act as specified in the revised Privacy Policy) will, to the fullest extent permitted by applicable law, constitute your consent to those changes. However, we will provide notice and obtain your consent (opt-in or opt-out) if required by law. Note that you may need to consent to our new policies to continue using the Website.     CONSENT TO TRANSFER

    Warehouse Cinemas is a company in the US. Please be aware that the data we collect will be transferred to and processed in the United States and other countries. By using the Website, or providing us with any data, you fully understand and unambiguously consent to this transfer to, and processing, usage, sharing, and storage of your data in the United States and other jurisdictions, for which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen. As a result, this data may be subject to access requests from governments, courts, or law enforcement in the United States and other countries according to the laws in those jurisdictions.
